Red 360 LLC (referred to as “Red 360,” “we,” or “us”) provides the Reddy Order Platform, which is a virtual marketplace connecting users with local restaurants.
This Privacy Policy describes the ways in which Red 360 collects, uses, discloses, and protects Personally Identifiable Information (PII) of Customers.

I. Information Collection

Red 360 collects information about you or your consumers as a result of transactions made through the Platform, which includes Personally Identifiable Information (PII).

A. Information Collected Directly from You

When you register, make a purchase, or use the Platform, we may collect the following PII or contact information:

• Account and Contact Information:
  Information provided when registering for an account, such as your name, email address, and other contact information, which you agree to keep accurate and up-to-date.

   

• Transaction Information:
  Details regarding your orders, including the items ordered, number and dollar amount of orders, dates and items of sales, and your location. This constitutes “Order Data.”

   

• Payment Information:
  We may collect payment details to charge sums for purchases, which is handled by Red 360 and its third-party payment processors.

   

B. Information Collected Automatically

We may automatically collect technical data and related information when you use the Platform:

• Device and Technical Data:
  This includes device identifiers and other technical information about your devices, systems, and application software, and peripherals, gathered periodically to facilitate the provision of software updates and product support.

   

• Usage Data:
  This is gathered to track and report your activity inside of the Service, including for analytics purposes. This may also include information about equipment on which the software is installed or through which it is accessed.

   

• Monitoring:
  Red 360 reserves the right to monitor any and all information transmitted or received through the Platform for operational and other purposes.

   

C. User Content and Feedback

• User Content:
  You may provide content to the Platform, such as reviews, photos, data, or text (“User Content”).

   

• Feedback / Ideas:
  If you provide comments or ideas (Ideas or Feedback) about the App (including improvements to it), you agree these are not Confidential Information.

   

II. Use of Collected Information

Red 360 uses collected information, including PII and transaction information, for the following purposes:

1. Providing and Improving the Service:
   We use data to provide our services, for research and development, and to improve the performance of the software or develop updates.

    

2. Order Fulfillment:
   We use your PII (Order Data) to process and execute your Customer Orders, which includes sharing information with the specific Restaurant and relevant Delivery Partners.

    

3. Marketing and Analytics:
   We may use your information for market research and/or for commercial marketing purposes. Aggregated and anonymized data may be used to provide services generally.

    

4. Internal Business and Compliance:
   We use data for internal business purposes, verifying compliance with the terms of service, and enforcing our rights.

    

5. Communication:
   We may use the contact information you provide to communicate with you electronically, including sending notices, agreements, disclosures, or other required communications.

    

III. Information Ownership and Disclosure

A. Data Ownership

The data included in an Order (Order Data), which may include PII of Customers, is jointly owned by Red 360 and the Restaurant from which you ordered.

B. Data Sharing (Disclosure)

We may disclose your personal information, including PII, to Third Parties for purposes related to your use of the Platform:

• Restaurants and Delivery Partners:
  Information (such as delivery address and order contents) is shared with Restaurants to prepare your order and with Delivery Partners to facilitate delivery.

   

• Third-Party Services:
  We share information with third-party service providers, such as payment processors, and integrated services like Google Maps.

   

• Service Providers / Affiliates:
  We share information with affiliates and service providers to facilitate the provision of services.

   

• Feedback / Ideas:
  Any Feedback or Creative Ideas you submit about the Platform are not Confidential Information, and Red 360 may use them without restriction for any purpose and may disclose or use them without compensation.

   

• Legal Requirements:
  Information may be disclosed in response to a subpoena or court order, or as required by applicable law, rule, or regulation.

   

When Red 360 provides tools enabling you to export information to third-party services, you agree that Red 360 may transfer that information; however, Red 360 is not responsible for any third-party service’s use of your exported information.

IV. Data Security and Your Rights

A. Security

Red 360 implements and maintains commercially reasonable administrative, technical, and physical safeguards designed to prevent unauthorized or unlawful processing, destruction, alteration, or access of PII.

B. Cooperation on Privacy Laws

Red 360 shall reasonably cooperate with you in connection with your rights under applicable privacy and data protection laws and regulations, including reasonably assisting with responding to, and complying with, verifiable consumer or data subject requests.

Information Red 360 collects about you or your consumers is subject to this Privacy Policy.

  For disputes related to your use of the Platform and the associated Terms of Service, the governing law is that of the State of Texas, and the courts located in Harris County, Texas.
